1. About ViralKit

ViralKit is an AI-powered content creation platform designed to help founders, businesses, and creators generate short-form video content and related creative assets.

ViralKit is operated from Sri Lanka.

2. Eligibility

You must be legally capable of entering into a binding agreement to use ViralKit.

By using the Service, you represent that the information you provide is accurate and that you have the authority to enter into these Terms.

ViralKit is not intended for children under 13 years of age.

3. Your Account

You may need to create an account to access certain features of ViralKit.

You are responsible for:

• Providing accurate account information
• Maintaining the security of your account
• All activity performed through your account
• Ensuring that your use of the Service complies with these Terms and applicable laws

You must not share, sell, transfer, or otherwise misuse your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe present a security, fraud, abuse, or legal risk.

ViralKit may offer free trials and paid subscription plans.

5. Billing and Payments

Paid subscriptions are billed on a recurring monthly basis unless otherwise stated at the time of purchase.

Payments are processed by our third-party payment provider, Polar.

ViralKit does not store your complete credit card or payment credentials.

By subscribing to a paid plan, you authorize the applicable payment provider to charge the applicable subscription fee according to the billing terms presented at checkout.

6. Cancellation

You may cancel your subscription at any time.

When you cancel a paid subscription, your subscription and paid access will generally remain active until the end of the current billing period.

After the current billing period ends, your subscription will not automatically renew.

Cancellation does not automatically entitle you to a refund for the unused portion of the current billing period.

7. Refunds

Payments made for ViralKit subscriptions are generally non-refundable.

However, ViralKit may, at its sole discretion, review individual refund requests where a user has not meaningfully used the Service.

Any refund provided under such circumstances is an exception and does not create an obligation for ViralKit to provide refunds in similar circumstances.

Nothing in this section limits any consumer rights that cannot legally be waived under applicable law.

8. Content Limits and Usage

ViralKit plans may include daily content-generation limits and other usage limits.

Usage limits may vary depending on your subscription plan.

Limits are intended to prevent abuse and ensure reasonable availability of the Service.

You may not attempt to bypass, manipulate, automate around, or otherwise circumvent usage limits, account restrictions, or technical controls.

9. Your Content

You may provide information and materials to ViralKit, including:

• Product or website URLs
• Product descriptions
• Prompts
• Demo videos
• Other materials required to use particular features

You retain ownership of content that you submit to ViralKit.

You are solely responsible for ensuring that you have all necessary rights, permissions, licenses, and authority to submit and use such content through ViralKit.

For example, you should only upload a demo video if you own it, have permission to use it, or are otherwise legally authorized to provide it to ViralKit.

You should only submit information about products that you own, operate, manage, or are otherwise authorized to represent.

You must not upload or submit another person's content, private information, intellectual property, or other materials without the necessary permission.

10. License to Operate the Service

By submitting content to ViralKit, you grant ViralKit a limited, worldwide, non-exclusive license to host, store, reproduce, transmit, process, and otherwise use that content only as reasonably necessary to:

• Provide the Service
• Generate requested content
• Display your content within your account
• Maintain and operate ViralKit
• Protect the security and integrity of the Service
• Prevent abuse and enforce these Terms

This license ends when the relevant content is deleted, except where continued retention or processing is reasonably necessary for legal, security, backup, or legitimate operational purposes.

11. AI-Generated Content

ViralKit uses artificial intelligence and machine-learning technologies to generate content.

AI-generated outputs may include hooks, captions, scripts, videos, avatars, or other creative material.

Although ViralKit is designed to produce useful and engaging content, we do not guarantee that:

• Generated content will be accurate
• Generated content will be unique
• Generated content will be suitable for every purpose
• Generated content will comply with every platform's rules
• Generated content will receive a particular number of views
• Generated content will become viral
• Generated content will generate revenue or business results

AI-generated content should be reviewed by you before publication or commercial use.

You are responsible for determining whether generated content is appropriate, accurate, lawful, and suitable for your intended use.

12. Commercial Use of Generated Content

Subject to your compliance with these Terms and any applicable third-party rights, you may use content generated through ViralKit for commercial purposes.

This may include:

• TikTok content
• Instagram content
• Social media marketing
• Advertising
• Promotional content
• Client work
• Business marketing

You remain responsible for ensuring that your use of generated content complies with applicable laws, intellectual-property rights, advertising requirements, and the rules of any platform on which you publish it.

13. Prohibited Uses

You may not use ViralKit to create, upload, distribute, or facilitate content or activity that:

• Violates applicable laws or regulations
• Infringes copyrights, trademarks, patents, or other intellectual-property rights
• Violates another person's privacy or publicity rights
• Impersonates another person or organization for deceptive purposes
• Facilitates fraud, scams, or deceptive practices
• Promotes illegal activities
• Contains sexually explicit or pornographic material
• Promotes or facilitates illegal drug use or trafficking
• Contains malicious software or harmful code
• Attempts to exploit, attack, disrupt, or compromise ViralKit or its infrastructure
• Attempts to bypass subscription, usage, security, or access controls
• Abuses automated systems or generates excessive requests
• Harasses, threatens, or intentionally harms others
• Otherwise abuses the Service

We may remove content or restrict access where we reasonably believe these Terms have been violated.

14. Intellectual Property

ViralKit and its underlying technology, software, design, branding, interfaces, trademarks, and other materials are owned by or licensed to ViralKit and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not:

• Copy or reproduce ViralKit's software or interface
• Reverse engineer or attempt to extract source code
• Resell or sublicense the Service
• Create a competing service using unauthorized access to ViralKit
• Scrape or systematically extract ViralKit's content or systems
• Use ViralKit branding without permission

Nothing in these Terms transfers ownership of ViralKit's intellectual property to you.

15. Third-Party Services

ViralKit may rely on third-party services, APIs, infrastructure, AI models, payment providers, authentication services, analytics providers, and other technologies.

Third-party services may have their own terms and policies.

ViralKit is not responsible for the availability, performance, accuracy, or policies of third-party services that are outside our control.

Changes or outages affecting third-party services may affect ViralKit's functionality.

16. Service Availability

We work to keep ViralKit available and reliable, but we do not guarantee that the Service will:

• Always be available
• Be uninterrupted
• Be completely error-free
• Be free from bugs or security vulnerabilities
• Always produce identical results
• Remain unchanged

We may perform maintenance, updates, improvements, or modifications that temporarily affect availability.

We may also add, modify, suspend, or discontinue features at any time.

17. Account Suspension and Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive activity
• You attempt to circumvent usage or security controls
• Your activity creates a security or legal risk
• You fail to pay applicable subscription fees
• We are required to do so by law
• We discontinue the Service

If your account is terminated because you violated these Terms, you may lose access to your account and associated content.

Termination does not automatically eliminate obligations that arose before termination.

18. Account Deletion

You may permanently delete your ViralKit account.

Account deletion may permanently remove your account and associated content.

You are responsible for downloading or preserving anything you want to keep before deleting your account.

Deletion may not immediately remove information that must be retained for legal, security, fraud-prevention, accounting, or backup purposes.

19. Disclaimers

ViralKit is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.

We make no warranties that the Service or generated content will meet your specific requirements or expectations.

In particular, ViralKit does not guarantee business results, audience growth, engagement, revenue, conversions, or viral performance.

You are responsible for reviewing and approving content before publishing or relying on it.

20. Limitation of Liability

To the maximum extent permitted by applicable law, ViralKit and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, goodwill, or other intangible losses arising from or related to your use of the Service.

To the maximum extent permitted by applicable law, ViralKit's total liability arising out of or relating to the Service will be limited to the amount you paid to ViralKit for the Service during the three months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ViralKit and its operators from claims, damages, liabilities, losses, and expenses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of applicable law
• Your submitted content
• Your infringement of another person's rights
• Your use or publication of AI-generated content

22. Governing Law

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles.

Any disputes relating to these Terms or the Service will be subject to the applicable courts and legal processes of Sri Lanka, except where applicable law provides otherwise.

23. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last updated" date at the top of this page.

Your continued use of ViralKit after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

If a change is material, we may provide additional notice through the Service or by email.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in effect.

25. Entire Agreement

These Terms, together with the ViralKit Privacy Policy and any additional terms presented for specific features or services, constitute the agreement between you and ViralKit regarding your use of the Service.
